 Same-sex unions: Aktar Materjal u Riflessjonijiet

Fl-aħħar ħarġa, wassalnielkom il-punti prinċipali ta’ dak li qed titlob il-Malta Gay Rights Movement, kif ukoll it-tagħlim tal-Knisja kif preżentat mill-Kongregazzjoni għad-Duttrina tal-Fidi fl-2003. Illum, biex inkomplu nistudjaw tajjeb dan is-suġġett, qed nibgħatu: (1) silta importanti minn diskors tal-Papa Benedittu XVI f’Diċembru 2008, kif ukoll (2) l-interventi ta’ żewġ Presidenti ta’ Konferenzi Episkopali f’Marzu 2012 – (a) tal-Iskozja, u (b) tal-Ingilterra u Wales.

  • Papa Benedittu XVI, Diskors lill-Kurja Rumana, 22.12.2008

Waqt id-diskors ta’ kull sena qabel l-awguri tal-Milied lill-membri tal-Kurja Rumana, il-Papa Benedittu XVI għamel referenza għal bosta temi li jikkonċernaw il-missjoni tal-Knisja u l-ħidma tiegħu. Fost l-oħrajn, huwa aċċenna għall-kumplimentarjeta’ bejn is-sessi u dmir tal-bniedem li jżomm quddiem għajnejh il-futur tal-umanita’. Għalkemm ma hemm l-ebda referenza diretta għal same-sex unions, impliċitament wieħed jinnota l-emfasi li jagħmel Benedittu XVI dwar: (a) ekoloġija umana, frażi li jużaha għall-ewwel darba f’dan id-diskors; (b) li nisimgħu l-“lingwaġġ” tal-ħolqien fejn jidħol il-bniedem; (c) il-bniedem, b’ċerti għażliet li jagħmel, qed idur kontra l-Ħallieq u l-ħolqien; (d) iż-żwieġ bejn raġel u mara bħala sagrament tal-ħolqien, istitwit mill-Ħallieq. Din li ġejja hija s-silta li hi ta’ interess għal din il-ġabra ta’ tagħrif:

In so doing, she (i.e. the Church) must not only defend earth, water and air as gifts of creation belonging to all. She must also protect man from self-destruction. What is needed is something like a human ecology, correctly understood. If the Church speaks of the nature of the human being as man and woman, and demands that this order of creation be respected, this is not some antiquated metaphysics. What is involved here is faith in the Creator and a readiness to listen to the ‘language’ of creation. To disregard this would be the self-destruction of man himself, and hence the destruction of God’s own work. What is often expressed and understood by the term ‘gender’ ultimately ends up being man’s attempt at self-emancipation from creation and the Creator. Man wants to be his own master, and alone – always and exclusively – to determine everything that concerns him. Yet in this way he lives in opposition to the truth, in opposition to the Creator Spirit.

Rain forests deserve indeed to be protected, but no less so does man, as a creature having an innate ‘message’ which does not contradict our freedom, but is instead its very premise. The great scholastic theologians described marriage, understood as the life-long bond between a man and a woman, as a sacrament of creation, which the Creator himself instituted and which Christ – without modifying the ‘message’ of creation – then made part of the history of his covenant with humanity. An integral part of the Church proclamation must be a witness to the Creator Spirit present in nature as a whole, and, in a special way, in the human person, created in God’s image”.[1]

  • Artiklu tal-Kardinal Keith Patrick O’Brien (2012)

F’artiklu li kiteb f’The Sunday Telegraph (4.3.2012), il-Kardinal Keith O’Brien, Arċisqof ta’ St Andrew’s and Edinburgh, fl-Iskozja, qal li l-legalizzazzjoni taż-żwieġ bejn l-omosesswali ġġib riperkussjonijiet serji. Tajjeb li nifhmu l-kuntest: il-ħsieb tal-Gvern tar-Renju Unit li jillegalizza ż-żwieġ bejn l-omosesswali. Il-Kardinal O’Brien sostna li “ebda gvern m’għandu l-awtorita’ morali li jħott it-tifsira taż-żwieġ kif universalment jifhimha kulħadd”. Waqt li fakkar li d-Dikjarazzjoni tad-Drittijiet tal-Bniedem tan-Nazzjonijiet Uniti tiddefinixxi ż-żwieġ bħala relazzjoni bejn raġel u mara, O’Brien sostna li ż-żwieġ bejn persuni tal-istess sess huwa “sovverżjoni grotteska ta’ dritt uman li huwa aċċettat universalment”.

F’dan l-artiklu – li ċerti espressjonijiet fih qanqlu reazzjoni minħabba l-lingwaġġ qawwi użat – il-Kardinal Skoċċiż kiteb: “Jekk iż-żwieġ bejn persuni tal-istess sess jiġi legalizzat, x’se jiġri jekk għalliem ikun irid jgħid lill-istudenti tiegħu li ż-żwieġ jista’ jfisser biss – u li minn dejjem kien ifisser – l-unjoni bejn raġel u mara? Allura d-dritt ta’ dan l-għalliem li jżomm u jgħallem din il-viżjoni jiġi rispettat jew jiġi mċaħħad lilu? Allura kemm l-għalliem kif ukoll l-istudenti tiegħu jkunu sempliċement vittmi tat-tirannija tat-tolleranzi, eretiċi li ladarba ma jaqblux mal-ortodossija imposta mill-Istat għandhom a kwalunke kost jiġi meqruda?”[2]

 

  • L-Ittra Pastorali tal-Arċisqof V. Nichols u l-Arċisqof P. Smith (2012)

Fil-kuntest ta’ dan id-dibattitu, huwa interessanti li nirreferu għall-Ittra Pastorali maħruġa mill-Arċisqof Vincent Nichols u l-Arċisqof Peter Smith, rispettivament President u Viċi-President tal-Konferenza Episkopali tal-Ingilterra u ta’ Wales, fil-11 ta’ Marzu 2012. Huma għamlu dan fil-kuntest tal-preżentazzjoni ta’ consultation paper maħruġa mill-Gvern Ingliż li fiha hemm proposta ta’ bidla fid-definizzjoni legali ta’ żwieġ b’mod u manjiera li l-istituzzjoni taż-żwieġ tkun tinkludi same-sex partnerships.

Nichols u Smith ifakkru lill-Insara dwar numru ta’ prinċipji fondamentali dwar iż-żwieġ. L-għeruq tal-istituzzjoni taż-żwieġ jinsabu fin-natura tagħna. Ġejna maħluqin raġel u mara, u miktuba fin-natura tagħna hemm dan il-pattern ta’ kumplimentarjeta’ u ta’ fertilita’, pattern li ma jinsabx biss fit-Tradizzjoni Nisranija, imma wkoll f’ħafna tradizzjonijiet reliġjużi oħrajn. La l-Knisja u lanqas l-Istat m’għandhom s-setgħa li jibdlu l-pedament taż-żwieġ[3]. Barra minn hekk, in-natura taż-żwieġ mhix kwistjoni ta’ opinjoni pubblika.

Iż-żwieġ bħala impenn dejjiemi bejn raġel u mara għat-tnissil u t-trobbija tal-ulied huwa espressjoni fondamentali tal-umanita’. Nichols u Smith ifakkru li “its status in law (i.e. taż-żwieġ) is the prudent fruit of experience, for the good of the spouses and the good of the family. In this way society esteems the married couple as the source and guardians of the next generation”. L-Isqfijiet ikomplu jelaboraw dwar l-aspett pożittiv tal-istabilita’ taż-żwieġ għall-ġid tal-iżvilupp tar-relazzjoni bejn il-miżżewġin, għat-trobbija tal-ulied u għas-saħħa tas-soċjeta’. Huma jfakkru li l-Knisja, qabel ma titkellem dwar żwieġ-sagrament, dejjem tibda d-diskors tagħha dwar iż-żwieġ bħala istituzzjoni naturali, u tant hu hekk li l-Knisja tirrikonoxxi ż-żwieġ ċivili. Huma mhux biss jisħqu dwar l-għana tar-rabta taż-żwieġ u l-viżjoni għolja u nobbli tiegħu, u l-qdusija fiż-żwieġ, imma jitkellmu wkoll dwaru bħala xhieda fis-soċjeta’ u kontribut għall-istabilita’ tagħha, b’mod li ebda istituzzjoni oħra ma tagħtiha.

Il-konklużjoni tal-Ittra tal-Arċisqof Nichols u l-Arċisqof Smith fiha ħafna x’wieħed jixtarr: “The reasons given by our government for wanting to change the definition of marriage are those of equality and discrimination. But our present law does not discriminate unjustly when it requires both a man and a woman for marriage. It simply recognises and protects the distinctive nature of marriage. Changing the legal definition of marriage would be a profoundly radical step. Its consequences should be taken seriously now. The law helps to shape and form social and cultural values. A change in the law would gradually and inevitably transform society’s understanding of the purpose of marriage. It would reduce it to just the complementarity of two people involved. There would be no recognition of the complementarity of male and female or that marriage is intended for the procreation and education of children. We have a duty to married people today, and to those who come after us, to do all we can to ensure that the true meaning of marriage is not lost for future generations”.[4]

I think what’s terribly important at this present stage of the debate is to keep the focus on marriage, and is to say, as I have said twice now already, this is the nature of marriage, it is written into our nature, it’s not the possession of the Church nor of the State to change, and it is absolutely important that that is the focus of what we do and what we say. ġ… Nichols jiċċara xi punti li kien għamel qabel, f’okkażjoni preċedenti, dwar civil partnerships. Fid-diskors ta’ Diċembru kompla billi qal hekk:ħ I think what I have done is recognise the existence of legal arrangements for same-sex partners who wish to avail themselves of protection to do with rights and property, inheritance and access to each other. You should, I think, pay attention to the fact that when that legislation was put in place, to which we objected, there was a very very clear undertaking given by the government that this should not be confused with marriage. The actual scope of the same-sex union regulation is not the same as marriage because when it comes to the same-sex partnerships there is absolutely no reference to the sexual relationship or sexual activity which is obviously essential to marriage, so there is a profound difference in law in this country at present. Now what we have to do – and we have to keep clear that the argument now is about the nature of marriage, and that’s why that will always be the focus of my comments at this stage – we have to be able to see and say and persuade people that marriage is the crucial foundation of the family and that is what we do not want changed.”
